BTW....what the hell is a drum circle?

Actually I have what I consider to be the good fortune to be able to attend the Rocky Boy reservation pow wow every year in northern Montana, and I get to listen to and record drum groups (drum circles) from tribes all over the country. (My girlfriend is Native American, born in Montana.) It's pretty amazing. Basically there's a group of men sitting in a circle around a large hand made kettle drum, and they sing (usually with women accompiniment) some pretty awesome and powerful melodies over very strong beats. They go til about 4 AM and start up again at about noon time for 4 days. No drugs, no alcohol.

This is assuming that's what Crawdad meant by drum circle.

Here's W.I.S.C's definition:

-Drum Circle ,where members can collaborate to build a tribal type drum and percussion/vox/sound/anything that can create a rythm jam.

Here's an idea...

Could we cover a song in the style of another homerecker?

I want to do the Muppet Theme Tune in the style of B. Sabbath.

"It's time to put on makeup..."

Roar - crash - weird e-bow underwater sound

Aargh - key change and double-tempo

Strange drums!

5..4..3..

"...on the Muppet Show tonight"

I'd buy it.

Cheers

I like Alibish's idea.

Maybe write an actual song in the style of another member . . . try to mimick their writing style, and maybe try and do an imitation of their voice and playing, etc.

alibish has a killer idea! 'It's Not Easy Being Green' in SLuiCe's style with 20 different time signatures. now that would be something to hear

i've voted for "cover another member's song"
i'm hoping that it's okay to cover the other member's song in another style, because that's kind of my thing.

i would also like to give persmission to any member of this board to cover my music (as if anyone would want to)
the majority of my original music is located at www.mp3.com/erich

LOLOLOL :D :D :D

that was frickin' hilarious... :D :D I almost wet myself. :p

I think Lt. Bob's on to somethin' too... We could take the Barney Song and do it Sluice style: 7/13 timing... transposed to A# minor 9th augmented 13th...

:D :D

We are discussing performance rights when it comes down to posting music on the internet. Regardless of if money is exchanged, these rights exist.

Those who are thinking of the 'fair use' clause, or are thinking that 'No money exchanged, means it's okay', read this:

http://www.serve.com/marbeth/music_not_fair_use.html

You are describing a common mis-use of the 'fair use' clause.

ASCAP, BMI, SEPSAC, etc. are just ways of getting 'mass' permission to their collection of works.

Now, as to why posting on the internet triggers the copyright law? It's a public performance.

http://www.ascap.com/licensing/licensingfaq.html

(note, and exemption listed is for not for profit EDUCATIONAL institutions, in otherwords, you'd have to be a REGISTERED EDUCATIONAL institution to use the 'its free' excuse!)

W.

P.S., most (I've never found one that doesn't) sites in which you post music, and most web hosts state clearly in their mandatory legal agreements that you HAVE obtained rights/permission to the material you post, or you cannot post it. What this means, is it now increases the number of people who can nail you by two when you post it on the net ...

wait a minute...you guys are laughing at me, aren't ya?

It's the coffee. If you drank as much coffee as I did, you'd have some pretty fucked up rhythms too!

:D

LOL.. I dunno man... I can't even think in some of the time sig's you use... :p

and Waldo... so where do you get permission from? The band? The label? I mean... what are the chances of me actually getting ahold of one of the band members.... (or a record label, for that matter.) :p

WATYF

Depends entirely on the works.

You can get blanket licensing (licensing=permission) from companies such as ASCAP, BMI, SEPSAC, etc. for yearly membership fees, etc..

ASCAP has the 'ACE' system in which you can check to see if the tune(s) you want to do are covered, etc. before you sign up.

It's not difficult to get ahold of people when you are asking for rights. I just sent off a reply e-mail to Dave Matthews folks regarding a consistent violation of rights from a member of NWR (that has been banned before).

W.

yeah.. but... I mean... I'm not gonna pay "fees"

geez... I just wanna do a crappy version of a song in my basement and then post it on NWR so 15 or 20 people can listen to it... :p

*sigh* why must everything be so difficult... :p

WATYF

In the future, I may get an ASCAP license for NWR, however, it's much more expensive for me to get one, than for members to do it. I can't even pay for the needed upgrades right now!

If I do this, I may require members who post covers to be paying members of NWR to cover the licensing expenses.

(p.s., I don't want to pay taxes just to live, or pay NWR's bills, but it's the law!)

start with the Harry Fox Agency which is authorized to issue mechanical licenses on behalf of more than 22,000 music publishers. You can get the mechanical license request form online. (http://www.nmpa.org/hfa/mechanical.html) The Harry Fox Agency issues a standard mechanical license which, other than relaxing the notice and accounting requirements, substantially mirrors the compulsory mechanical license. That means you will pay the statutory rate, and have authorization to make a new musical arrangement.

Waldo, did you contact his management group, or his label? ATO's a cool label, but they seem to be slow in responding.

Business associates which would be linked to his management.

W.

And on a more related topic...I think it's ego suicide for anybody other than WATYF to cover one of Erland's tunes. ARE YOU GONNA' SING IT BETTER???? LOL.

If that option wins, you can bet your ass I'm gonna' pick a song that was recorded like a total piece of CRAP to cover. Hey Jamal, can I do "Sunset Eyes?"

yeah, I was just reading aboot ASCAP's blanket liscences for websites... but I would never expect you to pay for my fees... i'm just trying to figure oat how to avoid paying fees at all... :D

and chris... thanks for the help... I'll look into that... I didn't realize it was such a pain in the butt to post a cover. I bet there's a billion covers out there that are posted illegally. Imagine all the little home wreckers all over the world who post beatles covers on their little websites and what not... sheesh... I gaurantee you that they didn't get no freaking "permissions"

:p
