I've been doing some semi-professional mixing for bands locally for a few years, in my home studio. I run Pro Tools. At the end of one particular project I'm doing, the band wants to know if they can have a copy of the PT sessions on DVD (probably so they can go into a bigger studio someday and have it remixed??) Easy enough, but is it common that the sessions are theirs too? Or should I work a price into them getting a copy of sessions on DVD? Obviously I give them the mix on CD, but I would think the sessions are mine, especially if we never talked about this before during the price negotiations.

Unless you've made a prior contrary agreement, the band owns the session.
Same applies for the recording royalties. Unless you agreed something in advance you own the gear and that's it.

It came as a surprise to me not long ago.
I assumed, like you, that I'd own the session and rights to that recording.

If you're running a business it's important to keep old sessions backed up.
I believe we're required to provide them on request for a certain period of time.

I give it away for free....when I can find someone who wants it.
