Do These Songs Sound Too Similar?

Getting ready to release my album soon and I recorded this song but I'm afraid it might sound too similar to a favourite artist of mine. I did base the song off of his style of this one song called "Peaches and Cream".. but after recording it, it almost seems to me that they sound too similar and the last thing I want is to get a nasty letter in the mail. (Not that I expect to go international with my music, but I do respect other musicians enough not to steal their music) So I thought I'd ask the experts on their opinions. Take a listen to the original song from John Butler Trio

and here is the song that I recorded called Fireflies for download. Let me know if you hear too much of a similarity

Copyright isn't about how similar 2 songs sound. The melody has to be pretty much the same (I think it's something like, if 5 notes in a row are the same with the same rythmic intervals....or something like that). Your song doesn't have the same melody, just the same feel.

But isn't that up to you? Do YOU feel that you "stole" someone's music? Something doesn't become a crime only when you get caught. I'm not saying anything you're doing is a crime, just trying to make a bad analogy, if you know what I mean. I'm not sure I know what I mean.

I don't think it's too similar. As regards respect, blue's and folk guys (and gals) used to borrow off each other all the time, it's one the highest forms of flattery.

Thanks for the info guys. Appreciate your input on this. Now time to figure out what to do with the song, and if I'll include it or not!

The guitar was a little out of tune. I would compress it just a little bit (or harder if you already are).

The vocal way on top of the vocal. The vocal has some low end frequency that rings every now and then. Sound like you were almost touching the vocal mic. Vocal level is a little out of control - gets really loud in spots. Pitchy note here and there.

The drums come in after almost 2 and a half minutes. The song is mostly over by then.

I would have to agree in that i would have like to hear a build up sooner in the song. But that's just the songwriter side of me. =)

If it was a coincidence I would say it was ok but if you intentionally based your song off that once then i feel that is too close.
