The Fraunhofer codec is indeed only used in commercial programs which is why I personally won't use it. I read articles a while back on how they were trying to rid the world of the other codecs and start charging shitloads of money for not only the codec but for even having material out on the net that used their codec.
If they had it their way, you'd be paying 400 bucks to make MP3s and a few cents per download from your site as well. It is my opinion that these things should be for the people and not subject monopolization.
Some may notice that Fraunhofer is available in shareware progs but only for use with smaller bitrates and whatnot. I use 192 as well...sometimes 160 but never 128....yuck.
That said, programs like CDEX come with ALL the free codecs including LAME and one can use any of them by changing prefs inside the program. (of course, they often do not include fraunhofer because...well...the program would not be free because the software company would have to pay huge licensing fees).
Now for a bit of education/power to the people stuff....have you guys checked out the OGG format?! Most folks agree it's better sounding than MP3 AND it's an open ended technology that will always be free and free from Fraunhofer's scrutiny. The OGG VORBIS codec is support by, I believe, EVERY major prog including CDEX and soudforge's stuff and even winamp. They're also working on some cool stuff for the future of OGG. At least check it out...
