What if someone already has my "band" name

i think "Sambuck's" is/was clearly modelled after "Starbuck's"... I think she wouldn't have got in trouble with a clearly different style and a name like "Sam Buck's".

i mean, if your name is william nelson (as mentioned before) you probably shouldn't try earning your money by wearing long (i wanted to say "indian-style" - but it's not politically correct) hair, a grey beard and play country-music. because that's kind of making money with someone else's success - when people pay you because you're like the other one and you do everything to support this.

Anyone remember Mike Rowe? His website was called mikerowesoft.com (or something like that)

The worst offender is Monster Cables, they went after someone running a website selling monster (the big scary kind). There are a bunch of other small companies that have NOTHING to do with audio that they went after as well. I will never buy a Monster product and I tell all my friends to avoid them as well (not to mention the fact that they are WAY too expensive).

I do agree that SamBucks was trying to "dilute" the Starbucks trademark, even if it was in good faith.

a local coffee house in my town had to change itself from McCofees to M Coffees because McDonalds sued them for having a "Mc" in their name!!

true story....

a band here in iowa called TEN GRAND had a different name VIDA BLUE before a person from the band PHISH offered up some money for the rights to the name...

i would sell my birth name for a dollar if someone wanted! not that vida blue was a birth name, but you get the picture.
Just saw the name PHISH and had to say that I think they blow ass bubbles.
Sorry.

My name's "Ollerton." I'm a solo artist, it's my last name. MY question is: What if someone already has the name trademarked or something? I did a search at the official trademark site and nothing came up.....but still....I don't want to come out with an album just to run into trouble.

You could call yourself "The Real Ollerton"...that gives you a one up.
