ah ok, I stand corrected...mebbe I should have said "owns the publishing rights"?

I reckon my question would be this: even if the artist is cool with it, does that save you from a court case? My understanding was that other entities decide who gets chased down regardless of the artist's input. Mebbe my view of record companies is a little dimly biased....heh..
 
As I wrote earlier, I was involved in 11 such cases. All but one were instigated by my publishers and / or my artists rights organisation. The one that was not instigated by them (but that was persued by them), was a blatent copy of a whole song, be it translated into another language, which would have been discovered sooner or later.
All cases apart from the 2 most serious ones were instigated, conducted, settled and / prosecuted without my prior knowledge. so you are right in stating it is not the artists choice.
