Donations, is it ok?

Hi guys.

I run a music group and has a channel on Youtube. I make music and videos and mostly cover songs. I search artist locally and if he/she has potential, I produce them and be part of my group. These artist are independent. My group is small and does not have enough financial power. I dont pay them and they dont pay me. All I want is I make them decent music video and try to make em popular, in return they make me popular producer and my recording studio. We dont make money in any means, not even, sell our tracks on itunes.

I was wondering if I could instead run a donation system to our group to help for our development and promotion of these independent artist. This donation honestly will also go to my effort in producing these videos since I dont make money and it takes a lot of time to make em. Also wondering, if this is ok and does not get in trouble with any copyrights and will not get sued from any people. Please let me know any concerns! Thanks!

I thought about this, since most people online just watch youtube and doesnt download music. So why not just make videos and ask for donations.

copying your post Jerberson, kind of interested in the answer and know someone on another board who deals with a lot of the legality of copyrights.

From my understanding though, you can't or "aren't expose to distribute" any copyrighted material, even if it's for free. You still have to pay royalties, but I'll find out for sure. Yes there are billion people on youtube doing covers and you ever wonder why google will never have you as an "associate partner" where they allow you to make money if you have covers on your channel? Because it's technically illegal. From a legality stand point why waste the resources chasing down all those people, it's impossible. But if your an actual business, your a much easier to target.

You may be able to just specify that they're donations to your studio, but still, to a studio where your technically recording copyrighted material...??? and promoting it... I just don't know for sure.

At the absolute bare minimum your going to have to apply for a synchronization license for the songs used to stay legal. Again if your a registered business you want to go about it the right way so you don't get sued, especially if your promoting the songs and the studio in the general public.
