Sample clearance

I had a debate with a friend of mine. He's telling me Samples even sample sounds would need clearance or I will get sued. I'm telling him that you can alter a sound to sound totally different that way I wouldn't have to pay anything(using Wavelab or soundforge). He says I would still have to pay cause there are people who are willing to go all out and find a source for a sample. I do not feel it is that serious. If I twist a sound around how can someone figure that out?? To me it's a stupid question.

What do you guys thing???????????
 
If you use someone else's copyright material -- you should be paying royalties....... the only exception would be sample CDs that you can purchase royalty-free.... Period.

Whether you then change them around or not is really irrelevant.... if you didn't write it, then you better bloody well pay to use it!

I don't agree with you bear. I believe sounds that are under one second, being processed in wavelab to sound totally different, you do not have to pay for it. If someone can take a bassline and make it sound like a hi hat (hypothetically speaking), come on! You ain't got to pay for that. How you gonna prove I got that from u.
 
Here's an original idea, instead of being a musical shoplifter, Buy or rent instruments and make your very own sounds. Then no one will want to sue you and you'll garner tons of respect from the music community.
 
Track Rat I hear u. But there is nothing wrong with making your own sounds on an instrument and layering it with an altered sample. I layer many sounds with acoustic instruments and sample sounds. That is how you come up with different sounds. Don't you agree?

Well reality is. All the sounds are basically "sample sounds". So I'm sure ya'll probably use them also.
 
I DO NOT use samples. Actually, that's untrue. I routinely use 24 bit/44.1KHz samples in 24 to 32 track arrays lasting from 3 to 10 minutes each. When triggered simultainiously, they form an entire song.:D
 
No point in arguing with him Track... this is a guy who thought it was a worthwhile effort to private email me a 2-word message stating "I disagree"...

Obviously, we're not dealing with the brightest star in the sky here.....

Well, see thats just silly. I think he makes pretty valid points. I think that sampling can be very creatively used/done. I also think that if you are sampling you should get permission/ pay a fee to use it. But thats not to say that someone is a bad song writer/musician for using any samples.
 
No one's saying that. But doesn't it bother you in the least that that someone wants a drum track so they just ramble through their CD collection, find a fat kick on one and a fat snare on another and lifts them off and uses that. What about the original artists/engineers hard work and creativity to get that fat snare and kick sound WHERE NONE EXISTED UNTIL THEY CREATED IT? It's easy to be creative when alls you have to do is shop for free drums without sweating over drum tuning, mic choice and placement, preamp, EQ, compression, etc.

I didn't hear anybody bitching when thousands of people made crappy "september 11th" songs using samples from the news. THAT is a hell of a lot worse than grabbing a sample off a recording and mucking it into something of your own creation.

You know where the line is. If you can take a sound on somebody's recording and make it your own then by all means do it. If you're going to take the sound itself and reuse it, then you should probably at least ask. Only a total asswipe with low self-esteem would try to enforce copyright on a note.

You know, I'd rather listen to a "remix" of a song using samples from the original work than listen to another dumbass rewriting a god damn bob seagar song and calling it his own. And what about cover songs? I don't hear anybody bitching about cover songs, and I know that NOBODY here does the paperwork before posting or performing a cover song. Very few things are original in music today, and especially on this BBS. Let's think about easing up on the high & mighty routines.

I disagree... he asked what we thought and we told him....

That wasn't enough for him apparently and he decided to argue his point, so we did....

There's a huge difference between asking for an opinion and leaving it at that, or getting opinions and then trying to convince others when their opinion isn't what he wants to hear.........

So your argument is that he didn't start the thread by explicitly stating any intentions to argue his point, and therefore he isn't "the brightest star in the sky?" Oh for pete's sake.

From what I remember for movie music licensing you actually could use up to around 7seconds without any permission. They may have changed that due to the new breed of "creative" producers who just nab an old chorus and call it their own.

The bottome line is that if somebody cant recognize their work they cant sue you. If you are talking about purchased samples then make sure they are royalty free.

I will let those without sin cast the first stone in regards to any ethics issues.

I said he wasn't the brightest star in the sky BECAUSE IN ADDITION to the post here, he took the trouble to email me a private 2-word message saying "I disagree...", which to me seemed like a silly waste of time since he already said EXACTLY the same thing here...

Sending me a PM is what prompted me to respond further.........

In any case, I don't give a flying fuck what you or anyone else thought of my answer -- he asked for people's opinion and I gave him mine....

You don't have to agree with me either, but don't flame me for answering!!
