Hey BBB, I knew you were just kidding (:D , damn it! :D )

I was geared up in "war" mode and was a little too eager to get on my soap box! But the truth is still the truth. I see a lot of people that are a little too sympathetic to these huge companies. I know its hard to run a company, and its even more difficult to run a large one. But you never hear any of them say something like...

"Sorry we haven't charged your card for the $6000 Soundcraft Board you bought from us. Our ability to take your money is under construction so we're just going to have to suffer until we get that fixed."

or

"Sorry we didn't charge you shipping on that item, our shipping department is being reorganized to serve you better."

Hey, they're looking out for themselves, that's fine. I'm just saying that we should look out for ourselves and if there's a company like Sam Ash who consistently and without fail institutes shitty policy and treats customers like theives or worse yet, like they don't exist, we shouldn't be shopping there. They can try to rectify their system and their treatment of customers, but that's something that they should've figured out how to do. None of their remedies have been honest so far, why would I believe that they are willing, or can change?

Which is what - in essense - I said; if the Sam Ash Music Stores and SamAsh.Com were the same company, I would definitely have to pay sales tax on internet purchases from SamAsh.Com because there are Sam Ash Music Stores in California.

And people definitely DO have to collect sales tax under those circumstances, and God help them if the California State Board of Equalization finds out they haven't been.

Because SamAsh.Com only has operations in NY and FL, they only collect sales tax from buyers in those states. If there is an operating office of the company within the state, sales tax _must_ be collected, regardless of where the shipment originates or where the order was reveived. The fact that the commerce is interstate is irrelevant if the company operates in any capacity within the buyer's state.

Check with SBE if you doubt me on this.
 
I remember reading something about "fair trade" guidelines in the 70's prohibiting sales tax being charged in a mail order capacity. I guess in E-commerce, the mode of communication has changed, but the fact is it's still mail order?
 
actually it's the exact same law. If you buy something mail order out of state there's no tax on that either. Whether you call your order in, send in a form or click to make your purchase online, the fact is that they are shipping (and billing) across state lines.
 
Im pretty sure you are supposed to pay sales tax on internet purchases....there should be some place on your income tax form or something or a separate form?......but if nobody comes looking for their money from me, im not gonna volunteer the info, cool......
 
This is kind of off track, but maybe some of you are familiar with the Indians in New York that sell cigarettes pretty cheap on the net. They apparently are not subject to state (or federal?) taxes. I'm wondering though if their sales are monitored and the purchasers can wind up being taxed? Isn't there a clause in the tobacco tax laws that levies taxes on tobacco imports? I wonder if the treasury dept considers "from the reservation" as an import?

Yes, but if that same company has any operations within your state, you must pay sales tax, even if the order is taken and processed completely out of state.

If you doubt me on this, check with your local SBE. No point listening to a bunch of guitarists.

I know this because I had to process tax on such sales for years.
 
No I totally agree with you...I was just commenting on catalog order being the same thing...I thought it was implied that there were no local operations.

About that cigarette tax thing, I wouldn't be suprised. In california, casinos are illegal, but on indian reservations they exist, and are open to the public. :) It's a very big issue, but they're pretty cool, so right on!

The status of Indian reservations is interesting, as are some of the spookier and darker applications of the loopholes such as the Wackenhut business.

But we are straying far from the sins of SamAsh.Com here.;)
 
Yeah I kinda just realized that. To get back on track:

I got my shipping label today. It almost brings a tear to my eye. I never thought the day would come. It just takes 2 months or so.
