Group Buy Interest?

Any problem getting it shipped to my office address and not my paypal? I'm there more than i'm at home, don't want to miss the courier :)
 
He's not selling them so sales tax doesn't apply in California. Now if he were marking them up beyond the shared expense of design and tooling, THEN he'd have to charge sales tax.

Kinda like if your friend is going to go to Guitar Center to buy a KXP2000mkii and you say, "hey, here's some money, could you pick up a G7000X mic pre while you're there". He doesn't charge you sales tax.

Mmm hmm. Listen, I don't care what you do, but if I imported $50K+ of stuff for resale, and say 1/10 of it sold in my home state, I would collect the sales tax, because I don't even want to consider the possibility of being personally assessed even $500 for the favor.

Some of the other posts are confusing sales tax and income tax, or just being generally confused about sales tax law (for example, to buy something "wholesale", you have to have a reseller's license, which means you are registered for sales tax, which means you collect from your in-state customers). And yes, everybody in the US in a state that has a sales tax is probably liable for use tax, but that's up to you, it's not Chance's problem.

I don't think Chance is making any money, so he needn't worry about income tax per se, but still with large deposits flowing into my Paypal account, I'd keep good records of expenses because the IRS would inquire about the deposits if audited (which isn't terribly likely these days, but still). But I don't see much risk there.
 
I do have a tax resale number and I file quarterly to the franchise tax board for my business. As far as this group buy goes, I am not buying and selling, you/we are buying and some are selling. For the products I got in previous GB's, I wrote it off as a deduction/business expense (gear purchase). I have been audited once about 10 years ago and it's no fun.
 
Chance, that makes it really easy then, why not just have Paypal collect tax for CA customers? It will do so automatically if set up in your profile. I don't think your argument about being an agent for all the group buyers will pass muster if you get audited (by CA) again.
 
Why is everyone freaking out about sales tax??? I've been in CA for 15 years and had a business here for 10. I've had to deal with sales tax in business. Aparently the other people here freaking out haven't.

IF we were buying the products from Chance, then he would have to collect sales tax. But we aren't as he has pointed out to no avail. We are buying the products from China and if there is a sales tax for Chinese purchases then we have to pay that (and I'm assuming that if there are any import taxes, Chance has already calculated that into the price.... I wouldn't know what's involved in buying stuff from other countries). Chance is NOT a reseller of the gear. This isn't splitting hairs or trying to twist tax law.

By way of example:
If Chance is going on a trip to Oregon (I pick that state because there's no sales tax) and says he's going to buy some hippie shirts he likes and they cost $20 each. And then say 300 of us say, "Hey Chance, I'd like a couple shirts, here's $40, can you bring me back two of them?" So Chance collects the money and buys an extra 600 shirts. WE DON'T PAY SALES TAX. We aren't buying them from him, we are buying them from some hippie in Eugene and Chance is just handling the transaction. It's not that complicated, you can call the tax board and ask them yourself if you don't believe me.

By way of another example (a real life one):
I've been hired numerous times as a project manager for record labels. As one of my duties, I source things, like manufacturing, printing, yada-yada. Much of this stuff would be taxable in California. Often I would set up an account to which the labels to would deposit money for me to work with, it's in my name. I go source whatever it is that needs to be made. Now when I give it to the labels, THEY DON'T PAY ME SALES TAX. Because they aren't buying it from me. If it was a california label (always was) and the manufacturer/printer/whatever charged sales tax, then I pay it to them on behalf of the label from said funds and I don't then charge additional sales tax to the label. If it was a california label and the manufacturer/printer/whatever was out of state and no sales tax applied, but I'm in california, they pay no sales tax to anyone. It's because nobody is buying anything from me, I'm only handling the transaction. Sure, my name might be on invoices and such, but still I'm not reselling anything - I'm handling the transactions. And before all the naysayers jump at me, I'm talking about stuff where a seller's permit doesn't apply.

So everybody chill-out. SHeesh.

LOL, but HEY that reminded me of something. THOSE FROM THE LAST GB THAT HAD RIBBON SAG. I need to know who you are so I can reverse check your past invoices to send replacment ribbons. WE'LL YAK ABOUT THIS LATER AFTER EVERYTHING HAS BEEN ORDERED. The ribbons will be coming anyway.

Hate to be constantly pushing the envelop on the web application, but if we all post here or email you, it seems like that could get unwieldy -- just a suspicion. Maybe a check box on the web order form? or a text field -- I, for instance, had it on the ACM-2 and ACM-3, but not the ACM-4 (like most people)

The one case that doesn't handle is the person who had ribbon sag, but isn't participating in this GB (but who could that possibly be? :) )

I will need two replacement ribbons for my ACM-3 mics from the last GB.

Also waiting for the shockmount for my ACM-670.
 
If i remember at all some ribbon mics will come
with a spare ribbon and the troubled ones from the former GB
will get them also.

I need 3 ribbons, one for the one I wrecked and one for the one thats left and one for the next one I wreck
