Fender doesn't need a copyright on the strat. They blow the compitition away in terms of sales volume on strat type guitars. They have the high-dollar custum shop strats, the american made strats, the hwy 1 strats, the mexican strats, and the squire strats.
Fender has a strat for EVERY budget...why would someone buy a non-fender strat and get the fucked up looking headstock?
Gibson Les Pauls, on the other hand, are high dollar axes and their Epiphone Les pauls ain't cheap. They NEED protection from other guitar makers that are doing quality Les Pauls with lower selling prices than Gibson...and companies that are making Les Paul style guitars that are (debatably) better quality than the Gibson.
I have tried to like Gibsons. I had a '72 Les Paul custum, A (don't remember the year) Les Paul standard, and a Gibson SG. IMO they all sucked. The les pauls are too heavy, I don't like the balance of an SG (it tilts forward when its on a strap), I HATE having a volume knob for each pickup, humbuckers suck if they are not distorted, and why does gibson think all their guitars have to have necks as fat as baseball bats?
Strats on the other hand, are about as perfect as an electric guitar gets.
In the long run its all a matter of personal preference though.
