man look if your unknown with no money to explode ur sound even if you have a copyright that doesnt mean jack
check it your an unkown local rapper you just created a fucken masterpiece one in a million typa songs you get the shyt copyrighted
so u think ok it's kool if I distribute my shyt, but the thang iz a copy right is just proof that the song is yours it's not gonna stop anybody from trying to lift it
but back to what I was saying so ur local selling local performing local....ect you happen to sell it to somebody or somebody recieves a copy one way or another of your stuff but they live like fucken thousands and thousands of miles away from you they remove the lyrics of ur music or just sample it they re release it and your fucked oh I love this or they download a beat from the net and use the beat for thier own benifiet profit at your expense
now if you live in L.A. and thu dude who lifed ur shyt lives in D.C.

and lets just say you found out and decide to take them to court well you forget a bunch of distributors have gone under and the one's left r being very piky wit their picks and not to mention they stole your beat so they would be fucken stupid if they went to distributor so the only other option is that they sell it with no bar code out the trunk on thu street earasing any proof that they sold it how you gonna prove they took it if they never sold a copy hence your fucked out of royalties hence the copyright fucked ur ass out of x amount of dollars and whatever publishing company jaked ur shyt I know what some of you might be thinking well ya how many can they sell out the trunk probly a few hundred ya maybe but if u got solid music and worken hard u can in the tens of thousands I mean shyt das a lot of freinds right their and you know they be profiting more than just a dollar of each cd now multiply uh huh you see what I mean know

now having said that... i'm assuming this hypothetical situation is an original piece of music and not a sample of some older music that you hypothetically put a new beat to.

a local DC band puts out 'the overnight scenario':
3 in the morning, the pancake house.
4 in the morning, we'll running to my house
5 in the morning, the lights go out
6 in the morning, she'll put it ...

4 months later JayZ has lyrics in his song that are very similar.

it only works if the artist involved makes legitimiate money. otherwise, you are trying to get blood from a crip.

Check this.... I could sit here and name dozens of times when mainstream artists stole, borrowed, sampled, whatever you wanna call it from the less fortunate.

Quick example - We got this underground group in Providence called AOI (Art Official Intelligence) ring a bell..... Nice group of kids been workin hard for many years tryin to get out their. Anyway De La Soul comes to town and they get backstage passes because they play the venue often. Everybody is partying havin a great time. De La Soul says they're looking to start a label and these kids have their type of vibe. They of course give them a copy of their CD. 6 months later De La Soul drops their album titled A.O.I Art Official Intelligence. fuckin shady

Anyway the point is this...could they sue...yeah probably....would they win...probably....can they afford the attorney - no
 
guard anything you do like GOLD - don't give it to anybody - its okay to let them hear it, but even if they are delasoul or jayz or anybody DONT GIVE COPY OF ANYTHING unless its something that you don't really care about.

When I go to a music lesson, I never bring my lyrics, and I only bring parts of songs, I never send my teacher wave or sonar files. Its really a dog eat dog world. Yeah, you gotta jam with people, & then they will hear some of your ideas but without a hard copy it will be hard to retain.

I'm sorry, but those guys were really naive to trust and give thier CD away. Copyright is only PART of the battle. Guarding your treasure like viginity among the wolves is the other half.
 
in regards to the kids who were raped by de la soul, if they have a strong case they can go present it to a lawyer and if the lawyer deems it possible to come out on top he will take the case and not charge until the case is closed which means the kids would probly win but dam to steal a name thats just weak I could understand a song or even a hook but a name to use as a title of an album and how many copies did de la soul sell again but them kids should look into it even if they only have the name registered at the county court house and flyers showing thier name along side de la soul that should be enough because that proves they had the oppertunity to take the name from that group and if it was registerd at the county court house as a DBA even more proof

uhhhh no...a DBA (Doing Business AS) is a local busness license. You mean if they had a federal trademark for the name they would have a case. And even if they did (which they didn't) it would still be a tough case as the trademark would have been for a business name and/or logo while de la soul used the name for a product not a business...

actually they would need a service mark and a trade mark and identify the trade mark and service mark as to how they will both be used it can be used for many things I just assumed they had a dba since they were working ground up and maybe your right about it being a tough case since artist always use songs and get away with it even though somebody has it copyrighted
 
actually this AOI thing is not as bad specially if De La signs these kids
it could be seen as some sort of introduction or name recognition and as pointed out above they've used the name for something different
keep in mind the names of the albums
not just AOI

they didn't give the name to another group in L I or something
and quite truthfully the name is not original as i have thought of if
my damn self no lie (before Dela) and i'm sure i'm not alone
