Behringer/Mackie Lawsuit Mixers

Up until the point that the lawsuit happened, weren't Behringer mixers exact copies of the Mackies? Wouldn't this mean that there are some good ones floating around ready to be swapped up by gidge-skates, I mean cheap-skates, like myself? How, if this is true, do you identify them? I have sen some of the older models, and have noticed some differences.
