Need advice for recording a Battle of the Bands show

this december i plan on recording a Battle of the Bands show where there will be probably 15-20 bands playing 15-20 minutes each. I've been trying to come up with the best way to make money off this. Does anyone have any experience with this? I can record top-notch quality stuff, so that's not an issue. I just want to figure out the best possible way to make this work. A couple ideas I've had have been to make a compilation CD with a song per band and put it out in stores to sell. This of course would require that I "buy" the songs, right? I have little experience in this, so take it easy on me. Otherwise I could make a cd of each band's performance and sell it to them. Any advice, ideas would be perfect.

ok first off...YOU DONT HAVE TO PAY THEM FOR IT ALWAYS! for example: #1. CONTRACT! write up a small contract agreement saying that music recorded at this event may be used to promote other interests by you. have them sign it and you are able to make money off of the recordings...just be kind and make sure to put what bands performed what songs on the compilation.

#2. JUST ASK! most bands are so desperate to get their songs out there that they will hand it to anyone. just make them a copy of the stuff so they can say they recorded something...they can use it as demos.

#3. THE SHIFTY! tell them you also book bands and ask for their contact info so that you can add it on to the cd. name drop a few clubs you've been to or "know the owner" and tell them that its being used as a compilation for club owners and other people so its a great way for them to get their name out there. cheap labor for you and free advertising for them.
 
I ______________ hereby agree that the songs recorded on _____ date maybe used by ____________ for __________ purposes and that _______ amount of the proceeds will see their way to ___________ after the cost of production is has been recouped.

A copy go to each member of the band and you. Each one should be signed - NOT - photocopied.
 
And print this up on a letterhead with your company name and address and all the good stuff. It looks professional.
 
a couple of minor questions:

1) what would a professional term be for the space marked for "purpose" - would it be as simple as "recording" or "marketing" or "publicizing"?

2) for the amount of proceeds that goes back to the band, would that be a percentage or an actual money figure? or would each band perhaps have a different situation and thus a different "number"?

3) for the part "will see their way to ___________ after the cost of production" - would this be the Band as a whole or the individual member who signs it?

4)lastly, what would part of the contract would need to be adjusted if the band or group agrees to give their music up freely - this may be rare, but could i essentially remove "and that _______ amount of the proceeds will see their way to ___________ after the cost of production is has been recouped."

Re Battle of the bands

I would suggest you agree to proceeds after costs of production and you retain say 20% for sundry agency costs and a fee for yourself for doing this.

The purposes should be all promotional and any distribution or airplay at your sole discretion but with the rider that no specific promotion distribution or airplay is guaranteed and all efforts will be at your sole discretion including choice of tracks and order of tracks on any CD.

A good idea is to offer them a special one with themselves as first or only tracks for a fee of say $3 per CD.

Also a disclaimer that this is purely a promotional venture at your sole discretion as to material and promotional matters and that this is not an agreement to promote any individual or group of individuals and no claim whatsoevever will be made for damages, loss, loss of profits, copywright or any other claim and that this agreement is to exclude legal remedies to the full amount that can be achieved in The USA or any of its states.


You could also put in a few terms of advantage to them that they will use best endeavours to supply suitable available artwork and agree that they have copyright to all artistic or music material supplied.

You could make it plain that this is a joint endeavour and all contrubutions and efforts are welcome and endeavours will be made to this end by all parties.

BTW I am not an attorney in the USA but I am elsewhere and I have my own band so I admire your efforts and undertaking. Would you consider my band in Australia? We are an eight piece with brass and original stuff including aboriginal stuff.
