My Wharfedales Came Damaged!!!!!!!!

So what are we going to do about this guy? I need my money back.
 
Typically, dealers won't refund your money until you've returned the product. Also typically, you need to get an return merchandise authorization (RMA) number, also sometimes just called RA.

What both these scenarios mean is that you and deepwater have to come to some sort of agreement regarding what is going to happen with your monitors and your money. In reading this thread it seems to me that deepwater is planning to (or has already) file complaints with FedEx to get damages for the broken monitor(s). My impression was that he plans on replacing your broken monitors with new ones. I could be wrong, but that's what I got out of it.

The bottom line is that you and deepwater haven't agreed about how to proceed with your complaint. He needs to respond to you privately, and you both need to come to an agreement as to whether you can wait for new properly working monitors to be sent, or return yours for a refund. He needs to give you a realistic time frame as to when he can get you the replacement monitors.

If they arrived busted and you don't want them or don't want to wait for an exchange, you are within your rights to ask for a refund in my opinion. But you will have to return the product before getting your money back. Nobody will send you the money first, at least that has never happened in my experience.

The normal thing is to send the bad monitor(s) back and get a replacement. But if you've lost confidence in your dealer, then perhaps you just should get your money back.

I had a worst case scenario happen a few months ago. I sent money to a dealer via paypal and never got the product. They lied about having it in stock, they lied about shipping it, and finally when they admitted they never had it in stock and faked the shipping date, they lied about returning my money. I'm still trying to get my money back. And this is a brick and mortar store (unfortunately out of state).

I only received one monitor of the two I ordered and it was damaged. It has been sent back. I asked him for a refund and he replied on March 31st that he would do so that night. Haven't heard a thing since.

Knowing that, he should send you a refund as he promised it.

However, today is Sunday, and March 31st was Thursday. That's not a lot of time, especially considering the weekend. I don't want to make excuses for him, if he said he'd send the money right away then he should do so. But if it were me being a dealer, I'd wait for the merchandise to come back before I refunded. He sounds a bit over extended at the moment.
 
well if he replied on the 31st that he'd issue the refund that night, weekend does not factor into this equation.....
 
Like I mentioned in my earlier post, I'm still waiting for my money back from last October from a dealer. It's rough out there. But you are right, if he said March 31st, then it should be March 31st.

It's unfortunate that HeyHeyMyMy is going through this, I know how frustrating and angering it is. Hopefully it will get resolved soon.
 
I received my Wharfedale monitors and mixer from deepwater a few weeks ago, all in perfect working order. I'm really sorry to read what has happened to some of you. I only hope that all works out to everyone's satisfaction in the end. Good luck!
 
I agree that the 31st to the 4th isn't that long, but it's another five days onto an already ridiculous amount of time. I'll stop posting complaints now though as it's not going to do me any good. I know he's probably just in over his head and trying to figure out what to do. But I don't enjoy getting jerked around, as I'm sure none of you do. SonicAlbert, I hope you're able to work out your problems too. Thanks to everyone else for their input too.
 
nope 31st to 4th isnt long, but if someone tells me they are going to do something on the 31st, i expect it done.......if its gonna take a week, tell me...if its gonna be another month, tell me......
 
my wharfedales from deepwater came in the mail almost instantly and in 100% working order when i ordered them last fall. i think as more time went by, he just got swamped by the increased popularity as the word spread. i noticed both of the main complaintents are in canada.. could this have anything to do with the delay and/or damage? overzealous customs assholes throwing stuff around in the back of the truck? just a theory.

I'm in Canada and as I mentioned above, I received mine fine.
 
Just call your Credit Card company. If it has only been going on for a couple of weeks, I'd wait, but for the dude who has been waiting FOUR months, just call Amex/Visa/whoever and I bet you you will have your money back within 48 hours! We had a long drawn out battle with Levitz Furniture to the tune of ~$1600 or so. Basically we ordered an entire living room set (couch, love seat and two ottomans) and they delivered all but the couch. Day before couch was supposed to come, they call and say it's discontinued and we can't get it. (1)You'd think they would refund us for the couch immediately, and (2)You'd think they would setup someone to take back the rest of the stuff (we had no need for an incomplete living room set) and refund us for that in a reasonable time. BUT NO! They didn't pick up the stuff for THREE months, and they NEVER credited us for the couch. BUT we called Amex the day they told us we weren't getting a couch and they got us our money back the next day...

Do you know if using PayPal changes things at all? I know that PayPal simply charges the money to my Visa card, but does that third party add any complications or do you think Visa would still be able to do it?
 
I think if you have a Paypal account, you need to file with them first, but when they then deny you (if the seller has a tracking # for the original shipment), you can go to your CC company. If you go directly to your CC company, PayPal might freeze your account, or yell at you, or other unpleasantries. Good luck!

whoa ya, watch out about pay pal. if you try to go the cc route they will for sure freeze your account. they suck, apparently
 
Well hopefully deepwater just refunds my money like he said he would.
 
Im really tired of this shady business

I sent an email and called deepwater regarding my damaged speakers and have not gotten a response. Am I ever going to get new speakers. Ive emailed him over a month ago and still nothing. Complete disaster. Horrible business practices. Any new advice, since Ive started this thread nothing has happened.

I really hope that you guys get your stuff resolced. It's too bad. Deepwater did seem like a decent person, but thats the problem with these boards. You don't really get to know who or how a person is. I hope other people read this thread. Many people have been very satisfied with Deepwater's service, but this thread has turned up too many problems for me to feel even partyl comfortable with doing business with him. I can understand some FedEx problems, but he has had too many. I can also understand not necessarily being able to get everything resolved instantly. However, what I can not understand is the lack of communication. I also can't see why he can't follow through with a commitment he made. I saw in another thread that he had been out of town. When I go out of town I make arrangements for my business stuff to be taken care of, or I make arrangements to be able to take care of them while I am gone. At the very least I inform clients that need information of what I am doing and when they can expect whatever it is that they need.

Lack of communication followed by empty promises is a HORRIBLE sign to come from someone you are conducting business with. It reeks of something fishy:(
