Legal/Legit?

I'm not looking to do anything underhanded or dishonest, let me make that perfectly clear. If there is good reason for not doing this, I won't.

I have through the course of time upgraded through several entry level version of Cakewalk and I am now at Sonar 3. All previous versions have been registered to me and now I'm wondering is it legitimate or legal for me to sell the older software(s). I was thinking of selling them on EBay or something like that.

Any thoughts?

I personally don't think there is anything illegal about selling used software.

Especially if you tell them up front that they are registered, and that no upgrades, or support are offered from the manufacturer.

Thats kind of what I was thinking. My intent was to be up front make no claims yet package all the updates I have collected upto this point.

Just trying to recover a few of my upgrade costs in the past. Besides...just too much unused software sitting around.

Do you think that Cakewalk would have a gripe with this?

I personally think cake wouldn't have any complaint! After all cake got the original purchase price from you.

Cake won't be upgrading or supporting the used software. And if someone sees an older version of cakewalk, it would possibly bring them to purchasing a newer version from cake.

You could also call them and see what they say. But I bet there are others selling their software on ebay. And if Ebay suspects illegal activity they will shut down the auction.

I was/am planning to call Cakewalk after I polled the every day people. I guess I'm expecting the developers and marketers to have a canned negative response so that they can hook the first-time buyers themselves.

Sorry to disagree with everyone here, but what you are proposing is NOT legal.

In essense, you do not OWN software. For the most part what you own is a license to use the software (read all that fine print next time you install a piece of software ). When you upgrade to a newer version the product, you are exchanging the license on your existing software for a license on the newer version. That's one of the reasons the price is so cheap. So even though you have two physical copies of software, you only have one license for use.

If you had bought the new version a full retail, then you would have a license for both versions, and could transfer them (i.e., you could sell the earlier version). However, if you have taken the upgrade path, you only have one license. If you sell that, you are "legally" no longer entitled to use the newer version (since you sold your only license).

I have heard of situations where Cakewalk has authorized people to give older versions to a school or library. You might want to consider that. But even in that case, I would be certain to get their written permission first.

I'm starting to appreciate your perspective. There's something to what you're saying with regard to the upgrades. I have written to Cakewalk and asked them their position on this. As soon as I get a response, I'll post it here.

I appreciate your input...I'll hold of on selling anything until I get it straight from Cakewalk.
