Can an Album be realeased/selled, if it was produced entirely with pirated software ?

Let's say a band don't have the money to produce an album, and decide to make the record in the basement, with a bunch of pirated software that was never boughted. "Just found over the internet".

This includes, very expensive plug-ins from big companies.


Can that album be realeased, and be putted on music stores like any other album, right next to all the commercial crap around ?

the answer would be no. Because said band would be too stupid to know how to obtain distribution. But it would be very funny if instead of buying their CD's, millions of people just downloaded their songs on a pirate music site.

If they did, it would be even more illegal than pirating the software in the first place, if thats possible

Oh, and the anwer is yes. A friend of mine has a cracked version of cubase and did his album in his apartment. It's now being sold locally at virgin records.

What i want to know is: if a band can go to jail for having an album in the stores, that was produced with pirated software.

Can someone ask for all the recipes of my software ? to corroborate that i produced my album with legal stuff ?



Is there some kind of legal procedure, that could analize my music and open me a trial, for using plug-ins that i never bought ?

First, there is no truth. Second, you can go to jail for anything. Finally, you can only get fined for using anything pirated. Selling something pirated will get you jail time. Selling your music, even though you used pirated software, is not pirating since YOU wrote it.
 
Ok, let's say i'm not the musician. just the producer. And i did the album for a band.

The band is cool, cause that's their music.

What about me ?

Well, you can do anything you want. I don’t see how you will get caught unless someone snitches you out. There’s a bunch of whistle blowing rat snitches in this world who they themselves download illegal software and music so the best advice is to not use pirated software for profit or even download it at all. I mean there is no way to tell if a recording was done with plug-ins or hardware and which one were used. But still, there is plenty of free stuff out there so really there is no reason to pirate. Pro software will not give you pro recordings.
