Buying Software Secondhand

Does anyone know about the legality of buying software from someone else rather than the manufacturer or licensed distributer?

One could save a good amount of money buying software on ebay, but is this any different than downloading it illegally on kazaa?
 
Software licenses are not transferrable, especially if the software has been registered by a previous user.

Half of the stuff on eBay is pirated Warez - not worth it.

hmmm i always though you could buy somebody else's software as long as they gave up all right to their serial numbers and whatnot. I know on the propellearhead website, they are warning people that if they sell their reason 1.0 to somebody, that first owner does not have rights to the free 2.0 upgrade. They didn't seem to show any concern about peple selling their softare, as long as they gave up all rights to it once they sold it.
 
yeah, assuming that the original owner hasn't made a copy of the program nor registered the serial number.

anyone else know?
