acorec is gone

My old band released 2 cd's both with several covers included. It literally takes 5 minues and costs $40 per song to do this for the small releases we did. You can roll the dice if you want, but it only take one acorec to bring it all down on you.

My understanding is that the composer has control of who does the original recording. After that, anyone can record the song without permission, as long as they obtain a license from HFA.
 
I just did an album for some guys that did mostly all covers.
And the fee was only like 55.00 for 1 song per 500. i dont know how much it is over that.
But As far as Reel person goes he sent me one of his cds over two years ago for free. If I remember right he sent alot of cds out for free.
He has always been a help to me and others that come along.
If he is guilty of anything on this board it is he is not the type to put up with a bunch of bullshit from someone.
And as far as paying for posting some cover songs, Do you really think that ascap or bmi has the time or money to go after some guy that is posting a few cover songs on the net and not making a dime off of it.
I doubt it.

What about me recording cover versions and then putting the tape/cd in my closet for like 20years with the rest of my originals?

How much will that set me back?

Free does'nt matter. You are in violation of the mechanical copyright law if you record a copyrighted composition even for your private collection.

Forgetting the lunacy of the above situation, the law clearly states that you must pay royalties to the publishing company if you *distribute* a CD with the song(s) on it. It says nothing about *selling*.

Example: Coke and Pepsi gave away CDs of Eric Clapton and other songs for free a few years ago. They had to pay royalties despite the fact that they were giving them away.

If you intend to *distribute* any copyrighted material in any way whatsoever, you must obtain the license and pay the royalties (fee).

How simple things, like the black letter of the law, can get hopelessly mis-interpreted and mangled appears to be the norm around here.

Anyway, my beef with A Reel Person had nothing to do with copyrighted stuff and everything to do with slander and disrespect. It is over as far as I am concerned. I got banned, he lost his website over at Nowhere Radio. Fair is fair. I hope he can learn to get along with people that have a differing opinion than his and stop jumping all over them. It gets old. fast.
