Official Rules
NETS BASKETBALL / SPRITE PROMOTION
Contest Dates: Feb 13, 2006 - March 5, 2006
Eligibility:
VOID WHERE PROHIBITED. Employees and immediate family members (spouses, parents, siblings, and children) of employees of New Jersey Basketball, LLC, b/d/a the New Jersey Nets (the “Nets”), the National Basketball Association and its Member Teams, NBA Properties, Inc., and their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents, shall not be eligible for entry. Also not eligible are employees of The Coca-Cola Bottling Group, Inc., (“Coke”), Emmis Radio Corporation d/b/a WQHT(“WQHT") participating retailers, their affiliates, subsidiaries, advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible.
To Enter:
NO PURCASE NECESSARY. To enter the contest, applicants must submit an audio file with their song along with their name, age, street address, city, state, zip code, e-mail address and phone number. Entries are accepted by mail to: “Nets Basketball/Sprite Promotion” Award Sweepstakes, c/o the Nets, 390 Murray Hill Parkway, East Rutherford, NJ, 07073. Hand print your complete name, age, address, zip code, plus daytime and evening telephone numbers. If you do not have a telephone, indicate “No Phone.” Contestants may also enter via the website, by uploading their rules to WQHT website (www.hot97.com). Failure to comply with this or any other official rule will result in disqualification. Mail your entry in a hand-addressed #10 envelope with first-class postage. Limit one entry per envelope. Not responsible for lost, late, illegible, mutilated, misdirected entries or entries not received in time for the random drawing. No entry tapes will be returned to applicants. All entries must be received during the contest period. Only one entry per person will be accepted. All entrants who comply with the above will be eligible to win. There is no fee to enter. No faxed or phoned entries will be accepted.
Prizes:
At the end of the contest period, one (1) Grand Prize winner will have their song played at a Nets Regular Season home game in-Arena and record their song in the Baseline recording studios. Recording time and date will be determined by the Nets and Baseline recording studios at their own discretion. The Nets will determine the game and time at which the song will be played.
Prize Drawing:
Winning submissions will be selected by the Nets from the pool of all eligible entrants based on submissions. Winners will be chosen based on the following criteria: 1. Lyrics must include the use of the names “Nets” and “Sprite”; 2. Lyrics must not contain any profanity or vulgar expressions; 3. Overall quality of recording; 4. Upbeat tempo and lyrics meant to hype up crowds; 5. Lyrics must show knowledge of the team and basketball, and reflect the positive image of the Nets. Winning song will be selected because they have met the criteria above and are judged to be the best quality song by the Nets. All decisions of judges are final.
The winner will be selected at the end of the contest period ending on February 29, 2006. The winner will be notified either by e-mail or mail. Limit one prize per family/household. Odds of winning depend upon the number of entries received. To be eligible to win in the Nets Basketball/Sprite Promotion, all entries must be received by midnight on February 28, 2006.
Winners may be required to sign an Affidavit of Eligibility and a Liability/Publicity Release prior to participation in and as a condition of receiving the prize. Winners' guests may also be required to sign and return Liability/Publicity Releases prior to participation in prize. The affidavit of Eligibility/Release of Liability/Prize Acceptance Form must be signed and returned within five (5) days of attempted notification. Noncompliance within this time period may result in disqualification and an alternate winner may be selected. Prize must be claimed within five (5) days of notification otherwise an alternate winner will be selected. Return of any prize/prize notification as undeliverable will result in disqualification and an alternate winner will be selected. The Nets and their affiliates reserve the right to substitute prize of equal or greater value. Acceptance of prize constitutes permission to the sponsor and its agencies to use winner's name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. By accepting prize, winner agrees to hold sponsor(s), their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the judges. Sponsors not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes or in the announcement of the prize.
Winners List:
For names of winners, please send a self-addressed, stamped #10 envelope along with a request for such list to Nets Basketball “Nets Basketball/Sprite Promotion” Award Sweepstakes, c/o the Nets, 390 Murray Hill Parkway, East Rutherford, NJ, 07073.
Indemnification: By entering the above-described contest, each entrant agrees to hold harmless and indemnify New Jersey Basketball, LLC d/b/a the New Jersey Nets, the National Basketball Association and its Member Teams, NBA Properties, Inc., NBA Media Ventures, Inc., Employees of The Coca-Cola Company and its "Promotional Participants" (i.e. Beverage Partners Worldwide (North America), CCDA Waters L.L.C., Coca-Cola Bottlers., Emmis Communications Corp., and all of their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents, from and against any and all liability, damages, claims or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation in the contest; or (ii) the receipt or use of the prizes awarded in the contest.
Miscellaneous:
Void where prohibited by law. No transfer, assignment, cash redemption or substitution of prizes will be permitted. All federal, state and local taxes are the sole responsibility of winner. All federal, state and local laws apply. Value of travel prizes may vary dependant upon departure/destination availability. Participants agree to abide by the terms of these Official Rules and the decision of the Nets related to this contest and all prize awards are final. By participating in the contest, winner consents to the use of his or her name and/or likeness, in any and all media, by the Nets, The Coca-Cola Bottling Group, Inc. and Emmis Communications Corp. the National Basketball Association and its Member Teams, NBA Properties, Inc., NBA Media Ventures, Inc., The Coca-Cola Bottling Group, Inc. and Emmis Communications Corp. and all of their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents, against for promotional purposes without additional authorization or compensation, except where prohibited by law. The Nets, The Coca-Cola Bottling Group, Inc. or Emmis Communications Corp. are not responsible for injury or damage to any participant’s or person’s computer related to or resulting from participating in this contest or from use of the Nets website. If, for any reason, the contest is not capable of running as planned by reason of computer viruses, technical failures, etc., the Nets reserve the right to terminate or suspend the online portion of the contest and to select the winner solely from the mail-in entries.
