Selling beats, sample clearances

Quick question, if I were to sell a beat that uses a sample and tell them in writing before they purchased:

"Samples have not been cleared. By purchasing any beat you recognize that it is now entirely the buyer's responsibility to get the sample cleared. "



Would I be clear of legal difficulties or problems that could arise from the artist not getting the sample cleared? Thanks in advance for the help
 
I believe that you initially selling the beat to the person is a violation of law as well... I could be wrong though....

i disagree . . . but what do i know . . . i would suggest CALL THE COPYRIGHT OFFICE AND/OR BMI OR ASCAP . . .
 
In all honesty, I wouldnt worry too much about it...
Yes, its illegal to sell beats with samples, becaus your profiting off somethin you dont own. Same reason it would be illegal for the emcee you sold the beat to, to profit from it.
However, if your an indie musucian, chances are, nobody who can do anything about it is going to notice.
Secondly, and this is my rebel side speaking... IF they did sue you, how great of exposure would that be? Shit, might be worth it.
