Hey Waldo,

what is your policy at your site, www.nowhereradio.com (Shameless plug) about posting "Cover" tunes? I know members here have done it, but I wanted your input and approval before I posted anything. Cheers, Dave
 
The disclaimer apon signup states that you are responsible for any licensing of samples, lyrics, tab, etc. etc., and that you have permission (from the copyright owners) to post the 'cover'.

In other-words, you can post 'em, but if you have, you told us that you are legally allowed to do so. Therefor, if they come after you, they come after you, not me.

Actually, I just read your rules, and #4 says " NO". Is this for real? I dont want to do anything wrong, or else my mom will yell at me.:eek:
 
Oh yeah,

And most 'classical' performances aren't much of a worry, since the copyright owners are long dead, and the law doesn't cover past 40 years or something... blah blah. When in doubt, look it up!

4b and 4c provide for 'yes, if it's not violating the law' and 'I have permission to use these samples and or this music'.

I could be wrong...but I thought that as long as your not selling the "cover" then it doesn't matter what you do with it..........ie a bar band doesn't need to have permission to play cover songs ....I would assume the same applies for just posting an Mp3 of a cover song, as long as you have no intent of making it a commercial item......Right Waldo?

Technically, it's still illegal to perform the song. However, it is a deciding factor in litegation, whereas if you haven't profited from the performance, than you are usually safe.

Rarely, when no profit is involved, do cover bands get targeted. And rarely do small bands ever get targeted. It's just not worth the expense, unless the target is rich!

THat's what I thought.................So, what your basically saying (without actually saying it) is go ahead and post the cover but I didn't tell you could do it.......Right? I mean you obviously have to disclaim yourself and such but you know the reality is that most people (like davidk) aren't gonna be the target of a major law suit unless it gets downloaded 55 million times in which case you'd have a napster type issue............

What I'm saying is that the disclaimer says 'You are telling us you have permission to do so', so we are out of the loop.

If you do something wrong and get caught for it, you are liable, not us!

Actually, I am branching out into the newfangled music of the Rock and the Roll that I have been hearing so much about. This Elvis guy looks insane.

It's hard to sell things on the internet anyway ("Just set up a website with a few 20-second song snippets and wait for the money to roll in." Yeah, right.) but it's extremely easy to generate a bit of a buzz, a profile, on the net. You can do this with cover tunes. Is that profiting? I doubt it'll ever reach the proportions of the Napster controversy though. :D
