Question About Midi Copyright/Permission

I have a midi file of an old song. I want to use the arrangement on a recording I can't find the artist. Can I use the file or do I need permission? The song may or may not be available for purchase if that makes a difference.

If you sell it...you don't really need copyright permission to record/perform...but you need to contact one of the licensing organizations, like the Harry fox Agency:

They will track your use/profit so they can pay the song copyright holder their share of the royalties.
