Logo: Trademark or Copyright?

On a logo design, should one trademark or copyright it? How do you get a trademark?
 
I believe you'll need a trademark, and I'm pretty sure that's quite a bit more expensive than a copyright (which is a whole different thing anyway). Go to the US Gov website to check it out.

You need a trademark. It's a much bigger pain in the butt than a copyright.
 
I thought it was copyright... It's an image which requires a certain amount of "artistic skill or judgement", or something similar...

I may be wrong though, everyone else seems to be against me :rolleyes:
 
No one is against you. I've done it several times. It's trademark, look at your CocaCola logo, you will see a TM after it.

It's an "R" since it registered.

And don't forget SM for Service Mark, which is what I have for my band name.
 
It's a little over $300 for a trademark. I hate to ask the dumb question of it being worth it....but....is it?

I truly think my idea is very original and creative and I certainly don't want it stolen. But come on...that's damn expensive.

At what point should I try to get a trademark?

If you ever go to court, it will save you tens of thousands in lawyer fees. I did it in 2002, took about a year.

Massive Mastering and I were in a band called Stonehenge. The name was trademarked. When Shrek II came out, Disney had to write a check because the band playing the wedding at the end of the movie was called (you guessed it) Stonehenge. It was a good investment.

You have to make sure you have the right trademark too. Myriad_Rocker, you could end up spending well over $10,000 just to file dozens of trademarks. Metallica filed 43, that's $13K, but it was a good investment for them because it protects their name.

There are a 33 registered trade and service marks with "stonehenge". The right mark was registered (below), though it's been cancelled, so anyone can use it now.

The trademark ran out a few months after the movie came out. The band has not been together for almost 8 years, but that was ours. My old studio was the J.E.M. (J. Engle Media) Music Complex.

The amount is none of your business, the check went to John. It wasn't hundreds of thousands of dollars or anything, but it was enough to make the investment worthwhile.

BTW, don't hire Robert S Pinzur as your lawyer, we tried to get him to keep the service mark going. He never got around to it. Fucker.

Of course it's none of by business, you don't have to be a dick about it. A simple "it's private" would do.
