Hidden Tracks....No copyright needed?

Question...

Im planning to do a remake of rap song originally done by Nelly but dont plan to include it with the rest of my original material because my songs are of a different genere.

I plan to put the remake at the end of my cd as a "hidden track".

Do I have to obtain the legal rights to use Nelly's song If I "don't" list the song on the insert -and- say I hid the song 5+ minutes into track 16 of my 12 track CD leaving the first 4:59 minutes of track 16 silent?

Example: Bloodhound Gang has a hidden track on there last CD at track 54 or somewhere near it. They included a clip from the radio show Loveline which they may or may not needed permission to do.

Yes. Just because a track isn't listed doesn't mean it's free game. And I would highly reccomend not doing this at all.

These guys are right...if in doubt, check with an attorney and clear it.

Have done some work with more than a few urban artists who have people on their staff fulltime that do nothing but go after people who sample, use hooks, etc.

Be careful. I've been in court before and it's no fun.
