I'm in the process of turning a very heavy deftones song into a piano song w/ electronic effects and beats behind it. There is loose chord relation and the lyrics are pretty much identical.

Can i post this as my song on my site?

Limp bizkit did a george michaels song on their first album, and they version is closer to georges than mine is to the deftones.

Does that give you guys enough of a picture? if not ill be done soon and post it in the clinic

The difference is that they had permission to cover it and you don't.

I guess you can post it if you want to be in violation of copyright laws and wish to be prosecuted. :D

On the bright side, they probably won't prosecute right off the bat. They'll simply tell you to remove it from your site. That is, if they find it at all.

But it's the principle of it...

I think it is ok as long as you arent profiting from it, isnt it??At least thats how I understood the copyright law...now if you were making an albumn with that song, you would need permission, pay royalties, etc...

I would think that since he would be posting it to the public, they would violate copyright law. What you said is kind of like copying a movie and saying it's right because you're not selling or renting it out.

Yea i wasnt planning on selling it. Also i want to make it clear that the reason i posted this question is because i want to do the right thing. Dont jump on me for being a copycat just yet :)

With that being said, i was planning on putting it on myspace or whatever just to switch things up a bit. My next question...

How hard would it be to contact deftones for permission w/ the exchange of royalties if i ever did decide to sell it?

Thanks
-Conrad

What you need to do is contact either ASCAP or BMI (or both). Full information is available on their websites as to what to do and how to go about it.

sounds cool, can't wait to hear it. i'm a pretty big Deftones fan myself.

This is a rather grey area. But of course, it's done all the time.
I haven't exactly looked at it, but we have two cover songs on our website for my band (in video format, actually, from a live show) and no complaints yet.

We plan on recording them for our album and getting the proper ASCAP/BMI rights (we'll need to pay royalties, that's all)

Ok, after visiting about 500 websites with versions (replicas) of classic rock songs they play in biker bars, i think its ok for me to post (not available for download) my rendition of a song. Im getting information on ASCAP and BMI and taking the steps necessary.
-The song cannot be downloaded
-The song is not being distributed
-The song will not be sold
-I think im ok
*Although i would really really like the song to be available for download, but i dont know if i should do that.

ps- the rough draft is at www.myspace.com/conradgray for the person who said they were a deftones fan.

forgot to mention the song is the third on the playlist
