There is no more new songs to be recorded ... Ever!

A band called the Planets did a song called one minute of Silence. The estate of John Cage tried to sue, claiming that the took they idea from Cage's 4 minutes and 33 seconds of silence. The Planets countered that theirs was better, and that it took them only one minute to say what took Cage 4'33" to say! :D

The ascap bmi royalty thing needs to be challenged..they suck...I know several restaurants that can't afford to pay the royalty extortion fees so they won't play music or let bands play at their restaurants...sure if your are playing covers or "Their clients" actual recordings royalties need to be paid...based upon their own argument, it certainly could be countered that the music of their clients is not original and deserves no protection as it was certainly influenced by music produced prior to the existence of ascap and bmi and modern day licensing.
 
So they'll get sued if they play their own music without paying ASCAP or BMI a fee? How is that not extortion?

The musicians don't get sued for playing their own originals...the venues they play at can get sued for not paying the "protection" ( licensing ) fees from the music mafia ..( BMI and ASCAP) and that is real...had no idea they could force a venue with original acts to pay up and perhaps it just needs to be challenged in court ...problem is... what restaurant / venue that can't afford to pay the licensing fees can afford to hire an attorney to fight the injustice of the rotten law suit?

No, the bands don't get sued (no one gets sued), the venue/organizers get fined.

What basis would they have to sue or fine a venue for letting someone play his own songs to his own audience? There are real cases of this?

No they don't get fined...they are forced to pay the licensing fee as ASCAP, BMI or SESAC see fit and it's their way of the highway..no budging . here's an article of one coffe shop that had to shut down their little open mics at the threat of being sued i.e. cease and decist or else muthafather and here' the results of a quick google of ASCAP sues restaurant
