Desk Design, Use if you wish!

I just mocked this design up for a desk. I dont have the funds of skills to make it, but im sure one of you may be able to use it! Il put down an image of it, if you want to build it, il post up the CAD's of it!

Enjoy..

I do not think it would be in your best interest to do that.

This closely resembles product patentent by Argosy. I do no think they would take it very lightly if you were to post CAD drawings on a public forum allowing others to knock of their product.

This is what I dont understand, the design is typical to hold certain types of equipement... realisticly if anyone were to set out to hold a mixing desk, this would be the design they would go for..

Have you people ever heard of design patents? I have several in my name being a furniture designer myself.

http://www.google.com/search?hl=en&l...ition&ct=title

[design patent]. A government grant of exclusive rights in a novel, nonobvious, and ornamental industrial design. A design patent confers the right to exclude others from making, using, or selling designs that closely resemble the patented design. A design patent covers the ornamental aspects of a design; its functional aspects are covered by a utility patent. A design patent and a utility patent can cover different aspects of the same article, such as an automobile or a lamp.

Search through old posts - Argosy already sent a cease and desist letter to another poster who did the exact same thing you are doing.

The actual patent number would be D/049,692:

http://patft.uspto.gov/netacgi/nph-P...y=PN%2FD396467

It was filed in 1996. How lucky are you feeling? Do you want to take the chance and assume Argosy doesn't stop in on this forum every so often?

so that means that we can't build and sell this desk. who's to stop me from building one or someone from giving me a design for one to build myself. i don't think that would be breaking any law.

Ok then.

So go ahead and give me the score for one of your own songs you want to make money on. I'll record it and take it to a recording label and sign a contract with them.

Apparently you don't have any regards for intellectual property rights.

You get the point?

Even if its patented to the point where i cant reproduce these for money, i can still do what i like in my own personal space. Even drugs.. which are totally against the law can be done as much as you like as long as it is in your own personal space. I culd take a score from a song, and reproduce it in my room if i wanted to.. but im not going to go and sell it to a record label.. just as im not selling the design to you.. all im doing is offering a design (which in fact measures up to look like an argosy console.. but in construction is NOTHING like an argosy console) for your own personal use.

If you dont like it, dont use it.

I don't think there's any law at all about you making it yourself. Or telling someone how to do it. What they might get tetchy about is if you publicly put the design on display. Its a bit like if you were to reverse engineer a bit of software and pu thecode on the net. However, you aren't publishing the designs for particular patented product. You are publishing the design for your own product, which may resemble the patented product, but isn't identical. And you aren't making any money from it. People who don't want to build a desk will buy one. People who do want to build one will build one, even if it looks a bit like something else.

Also, as previously stated it is the practical design for something of this function. This is the sort of thing I have in my head when I think about builing a desk.

If your really worried about it (which you aren't, which is fair enough), then publish the design with some wierd uneccessary shit like alien antennas or wings or monster truck wheels or something. The people who will want to build it will just ignore the wierd stuff and use the design as originally intented.....but thats just one of my crackpot ideas.

That said, I'm interested. I need a new desk. But I don't want you to get yourself into any trouble....

It seems I asked a patent lawyer once, and they said that it a violation of patent law for me to make something for my own use that was patented.

Thats the most rediculous thing ive ever heard. The reason patents are made are so that others cannot make money off someone else's idea. Whats the point in DIY in that case, im sure most designs for most furniture are patented. Shall we all just pack it in.. or get over-inventive with things that only need to be simple.

Realisticly.. id love argosy to persue this with me, i would happily cut up a load of MDF outside their main offices just because this whole idea is pissing me off quite a bit. Although, it does make me laugh an equal amount.

Firstly, yes i said firstly, (u.s. patent #1045745-45-10-71 for firstly) if i was to write out the score for one of my tunes, it would likely be my own shorthand type jibberish, probably written in crayon, that you would'nt understand anyway. Secondly, it would likely be a song about me performing unnatural acts to your many orifices. Thirdly, it certainly would not attract attention from any respectable label. Fourthly, (i am currently battling over the patent rights for this one) it's people like you that are causing such things as guitar tab to disappear. I don't personally use guitar tab any more but I was pretty shocked when I directed a young guitar player to some tab sites only to find out that most of them are being harassed or sued over your so called "intellectual property rights".

What a bunch of shit.

The discussion I had may have been with my (at the time) corporate counsel colleague, about whether the company could legally copy a design for internal use, and the answer was no. In other words, if you build this desk in violation of patents and then invoice someone for recording in your studio, your breaking the law.

As for copyrighting I-IV-V, a kew word for intellectual property is novel, or new. I-IV-V is not novel, and thus cannot be copyrighted.

you will only get in to trouble if it is EXACTLY the same. people get away with this with music all the time. just listen to the radio.

there is no way you could make that desk exactly the same unless you had their plans for it, a list of phone numbers with all their suppliers, etc. you are safe man...

It's a design patent, so they're covering the look, not the function, of the desk. Just change the look. I can't seem to access the patent images from here, or I'd give you some suggestions. If they have a straight cut, put in a curvy cut, things like that.
