remake of an old gameboy song....

Hey. I was wondering about this... I would like to recreate a rock version of a tune which is on an old game boy game... I know that might sound like a crappy idea to you but I need some advice.

Who do I have to get permission from to do this? I have downloaded a midi file which was recorded by someone else (as far as I know not Nintendo) my question is this:

do I need to ask for permission to do this from Nintendo and if I use samples from the midi file do I need permission from the midi songs creator?

Please help me out. If I do need to ask nintendo do any of you know what address I can use?

I have no idea. Check first with the Harry Fox Agency (http://www.harryfox.com/index.jsp). They handle mechanical licensing for a lot of popular music, though maybe not for video game music. If it's there, you can often license it online with a credit card (if you don't intend to make/sell more than 2500 copies). Otherwise, you'll have to track down the original copyright holder and gain permission and probably pay a licensing fee.

The standard here in Canada is 8.5 cents per song per copy, assuming you're covering the song and not using their actual recording.
